石家庄人第二次文明素质的提升缘于一个血泊中挺立的女人。1999年3月24日，已有两个多月身孕的出租司机魏新芳在石家庄市火车站拉了一个男青年，此人一会儿说到西二环，一会儿又说到北站。在北站存物场附近，该青年凶相毕露，一把尖刀架在魏新芳的脖子上，逼她交出汽车钥匙。魏新芳是一个娇弱秀丽的女人，在火车站蹲伏已久的歹徒怕是早瞄上了她的孱弱，然而，现在这个弱不禁风的女人面对寒光闪闪的刀锋却大胆地扑了上来，这使歹徒有些始料不及。搏斗中，魏新芳身中八刀浑身上下成了血人，但她毫不畏惧，拼死保住了出租车，并把歹徒的小手指咬断，以燕赵儿女特有的血气粉碎了歹徒的夺车计划。 魏新芳面对冷酷的现实，对着自己满身的伤痕，一次次想到死。但是，她坚信自己与歹徒斗争没有错，而在这场搏斗中失去的孩子是无辜的，难道说我舍出命来的作为就该得到这种结果吗？如果当时自己胆小怕事，把车钥匙给了歹徒，自己在当时当地完全可以脱身，但这样做显然助长罪犯的气焰，车主必将遭受重大损失，自己为车主挽回了损失，为什么反而要受到车主的怨恨！这是不公平的，我要为我的行为讨个说法。魏新芳想到拿起法律的武器，来保护自己应得的合法权益：自己与车主是雇佣劳动关系，自己又是在工作中为保护车主的财产而受伤，应认定为工伤，享受工伤待遇，在这种情况下，车主有责任和义务对其雇工负责。于是，她向长安区劳动仲裁委员会提出诉讼，长安区劳动仲裁委员会接受魏新芳诉讼，并于2000年1月5日立案，于3月8日正式开庭审理。单槐生、杨辉律师出于对魏新芳英勇行为的敬佩和对她所受待遇的同情，接受魏的委托，并义务为其代理。单律师认为：魏新芳在开出租车营运中为保护雇主财产而受伤，且失去已有两个月的胎儿，她因见义勇为遭受的重大损失，车主李某作为实际受益人，按法律规定应对魏有一定补偿的义务和责任。而且，魏新芳和李某之间存在个体工商户和雇员的关系，这一点李某已当庭承认，石家庄市工商局交通运输管理分局也出具了李某登记注册为个体客运出租车业户的书面证明。因此，魏新芳在工作中为保护其雇主工商户李某的财产而受伤，理应认定为工伤，享受工伤待遇，这在《中华人民共和国劳动法》，劳动部《企业职工工伤保险试行办法》及《河北省贯彻原劳动部（企业职工表现试行办法？实施细则》中均有明确规定。 某律师事务所邸律师也非常肯定地讲：既然两者之间劳动关系确立，不管有无劳动协议，在工作中因保护雇主财产而受伤，绝对应该认定为工伤，享受工伤待遇！ 长安区劳动仲裁委员会，魏新芳一案仲裁员郑华在接受记者采访时则说，我对魏新芳非常同情，但应否认定为工伤，必须依法处理。本案已终止审理，交有关劳动鉴定部门鉴定，然后才能依法裁决。 公安交通管理局的工作人员认为：石家庄市个体出租车已有700多辆，且属于雇佣司机给车主包车出租，而车主依规定必须挂靠到某一出租汽车公司，他们之间的劳动关系应如何认定？在运营中一旦司机在没有违章的情况下出现伤亡事故，雇佣双方如何处理解决，这方面引发的民事或刑事纠纷已很多，魏新芳一案是这一系列现象的典型，应引起立法部门、执法部门的特别关注，希望此案能推动这一方面立法的完善。 省个体劳动者协会的负责人对此事也表示关注：女司机为保护其雇主财产而身受重伤，雇主首先应从道义上承担一定责任。而且，二者之间的劳动关系确实存在，在案发前各自履行了双方的义务，在这种情况下，雇主应尊重法律，承担起自己应尽的责任和义务。 从事个体私营工作的一位先生也认为：中国个体私营经济空前繁荣，那么个体私营工作者和其雇员之间的劳动关系及工伤认定，虽然有法可依，但人们还是缺乏法制观念。魏新芳一案作为大众及传媒格外关注的典型个案，其裁决结果必将引起极大反响。
