Chapter 49 5. Unjust sentences have been completely rehabilitated

After Director Hao of the Organization Department of the Central Committee talked to me for the first time, I went to visit Comrade Zhang Tengxiao, who was in charge of policy implementation at the Party Committee of Renmin University of China, and asked for a solution to the issue of rehabilitating unjust cases.He said: We will go through the court procedures to solve this problem for you, but you need to find a witness to write the materials.A strong witness, the whereabouts of Zhao Yaobin, the head of Xi'an's underground intelligence organization, is unknown. Who should I go to write proof materials?After inquiries, I learned from relevant parties that Zhao Yaobin's file is in a certain department of the Central Committee, and that the leftover problems of the Xi'an underground intelligence organization can be resolved by it.So I wrote a letter to Minister Luo Qingchang.He asked the Political Department of the Ministry to write proof materials for me.Comrade Chen Zhongjing who introduced me to work in the Political Department of the Northeast Security Chief Command of the Kuomintang, and Comrade Xing Guoyan who worked with me in the Northeast underground intelligence team also wrote me supporting materials.Relevant parties forwarded these materials to the Beijing Higher People's Court.The Party Committee of Renmin University of China also sent people to the Beijing Higher People's Court to contact me about the redress of my unjust case.I thought that the issue of rehabilitating my unjust case had already been put on the court's agenda.After waiting for several months, I went to court to ask how the case was being handled.The comrades in the court said: You must file a rehabilitative appeal yourself, and then we can file a case for you to deal with rehabilitative issues.

On July 16, 1979, I wrote a letter of appeal to Comrade Jiang Hua of the Supreme People's Court, requesting to vindicate my unjust case.The letter was approved by the Beijing Higher People's Court.I visited the Beijing Higher People's Court.The person at the reception said: The appeal letter you wrote to the Supreme People's Court has been transferred to our court; but because there are too many people complaining, you can only be ranked on the National Day. On September 19, I visited the Beijing High People's Court again.The comrade handling the case told me: Your complaint has been filed for review and is pending for processing. On November 14, I went to the Beijing Higher People's Court.Comrades Liu Luobin and Fan Zhimin who were in charge of my case met with me.I stated in detail the circumstances of my injustice.Call for an early redress.Comrade Fan Zhimin said: In two days, you can talk again. On November 16, I went to the High People's Court and met Comrade Fan Zhimin.He said: I have read all of your case files, but the materials are incomplete.Who introduced you to the party?what time?where?Who sent you to infiltrate the Kuomintang military organs to do underground work?What time?where?Under what cover?What work did you do for the party?You go home and write a supplementary material and send it to me. On November 20, I sent the supplementary materials to the court. On December 11, I went to the Beijing Higher People's Court and met Comrade Fan Zhimin.He said: Your case has been closed and sent to the Beijing Municipal Party Committee for approval.After the approval, we will inform you that you don't need to press the application any more.

I have petitioned many authorities, and I feel that the Beijing Higher People's Court is very serious and timely. It took less than 3 months for a case like mine that was sentenced to life imprisonment and spent 18 years in prison to be rehabilitated. Solve, this is rare in other institutions. On November 28, 1980, I learned from relevant parties that the Beijing Municipal Party Committee had approved the opinion of the Beijing Higher People's Court regarding the redress of my unjust case. On the morning of December 10, I went to the Beijing Higher People's Court to urge the case.Comrades Liu Luobin and Fan Zhimin said, just right, today's court session will be held to resolve your issue.After the hearing, the chief judge Liu Luobin first read out the "Criminal Retrial Judgment of Beijing Higher People's Court".Its main content is: "After re-examination by this court, it is found that the original judgment found that Ge Peiqi's criminal facts, nature and punishment were wrong and should be corrected."Based on this, the sentence was amended as follows: (1) the original judgment was revoked; (2) Ge Peiqi was declared innocent; (3) the property confiscated in the original judgment was returned to me at a discounted price in RMB.So far, my unjust sentence has been completely rehabilitated.
