I learned that because the report I published in the "Worker's Daily" was later reprinted by many other domestic newspapers, the "fame" of Beidaihe Hospital spread throughout the country, which made the hospital's leaders very embarrassed and naturally angered. Sun Hengjun, who had been extremely dissatisfied with her for a long time, ignored the anger of all the hospital staff and listed a series of so-called crimes. A month ago, he laid off Sister Shen, who had worked hard in his position for 32 years. Deprived of the right to work in a hospital!

Beginning in June 2001, I went to Beidaihe six times and attended court three times, including one time as an attorney.I have been interviewing this case for as long as 4 years. On July 19, 2003, a full-page report was published in the "Worker's Daily" sponsored by the All-China Federation of Trade Unions. Afterwards, many newspapers such as "Beijing Times" and "Yangtze Evening News" reprinted my article.It's just that I didn't expect that my article not only didn't help Sister Shen, but brought her a series of troubles. In particular, she never dreamed that a proper lawsuit with the hospital would lead to her layoff.

As early as January 2003, a leader of Haoxin Hospital once told Shen: "Xiao Shen, you have to be prepared. Once you lose your lawsuit, the hospital will let you be laid off. They said that your lawsuit has brought bad news to the hospital. influences." On December 12, 2003, when talking with Ms. Shen, a hospital leader specifically pointed out: "When you come to the training class, you must study hard and realize your own mistakes." Ms. Shen asked, "What mistakes did I make?" He said: "It's a mistake for you to sue the hospital." After the training, the few people who were waiting for posts with Sister Shen all looked for their own jobs.Sure enough, as expected, the other three returned to their original posts, and only Sister Shen hit the wall everywhere.

On January 7, 2004, Beidaihe Hospital issued a circular, the main content of which was that Shen Shuping did not understand why she was rated as the last.The other 3 people have a deep understanding of their own gaps. After training, the comprehensive evaluation results: the other 3 people are qualified, only Shen Shuping is not qualified. After the other three people were rated as the last, their directors in charge pointed out their deficiencies when talking to them respectively, but the director in charge of Beidaihe Hospital said when talking to Shen Shuping: "Your work is impeccable. I don’t know what your shortcomings are.” Some hospital leaders also said to Sister Shen: “Why don’t you just admit your mistakes, keep your job, and don’t lose your job.” Sister Shen couldn’t accept it, so she again I decided to ask Sun Shuying for an explanation, but when I approached Sun many times, Sun always avoided seeing her.

On the afternoon of January 10, 2004, the hospital held an emergency meeting of middle-level and above cadres specifically for Shen's problem.A deputy director read out Shen's study summary, and he also emphasized that it was the newspaper that gave the hospital a bad reputation, and she did not admit her mistakes in the summary. Regarding the question of whether to allow Shen Shuping to take up the post, a vice president said: "She is good everywhere, but the newspaper matter, can't it be enough if she admits it? Do her work first."Sister Shen felt that she had made no mistakes during the whole process, so it was impossible for her to make a self-criticism that was not in line with the facts and against her will.At the same time, Beidaihe Hospital also believed in relevant documents that "the lawsuit has seriously affected the reputation of the hospital, seriously disturbed the work order, and required a lot of wasted energy..."

When Shen Shuping went to the hospital party committee office and the president's office many times to inquire about the reasons, Sun Shuying kept avoiding her. Zhu Xinxin, the deputy secretary of the hospital's party committee, said plausibly: "Is there any need to ask? Don't you always want to file a lawsuit with the hospital?" Don’t you always like to invite reporters to criticize our hospital? Let you be laid off now, and sue if you feel guilty!” Zhu also said that you should admit that the newspapers have had a bad influence and that the hospital’s financial income is not good, because you held several courts involving many people and caused more than 20 people in the hospital to testify in court. Offended these witnesses, that's why they gave you a low score...

On November 27, 2003, Sun Shuying, Secretary of the Party Committee and President of Beidaihe Hospital, clearly stated in the "Work Report and Personnel System Reform Report": "...At present, we (hospital) still have two cases of medical disputes that are being tried by the court. The dispute has seriously affected the reputation of the hospital, business income, and the mood of the medical staff, requiring a lot of wasted energy to deal with this aspect, and severe (heavy) interference has disrupted the work order of the hospital." Shen Shuping believes that besides the two medical disputes mentioned in Sun's report, besides her ongoing lawsuit, the other is the lawsuit that Yu Limei sued the hospital.

At the end of 2003, Beidaihe Hospital began to implement the personnel system reform plan in the four main systems of the hospital. More than 300 employees in the hospital voted and scored the work of the in-service personnel according to relevant regulations, and the four main systems respectively rated four "bottoms" Shen Shuping is one of them. Shen Shuping has her own views on being ranked last: "I was ranked last because I had a lawsuit with the hospital, and the leaders took revenge on me." A hospital leader told Shen Shuping: "If there is a last evaluation (you are ranked last), it is mainly because the newspaper published your lawsuit against the hospital, which has affected the hospital..." The leader of the hospital also specifically listed The Workers' Daily published the circumstances of the case.

A hospital employee made it clear: "The meaning of the hospital leadership meeting is not to give you (Shen Shuping) high marks." Another hospital employee admitted: "Some hospital leaders once hinted that I gave Shen Shuping a low score." Another employee said: "A certain hospital leader said at a meeting that low marks are given to those who are heartless and receive red envelopes, and those who bring bad influence to the hospital or file lawsuits. Someone said at the time : Then there is no one else but Shen Shuping." On January 7, 2004, Beidaihe Hospital issued a “Notice on the Competitive Situation of the Four Last Personnel”, which stated: “During the reform of the hospital’s personnel system in 2003, after passing the evaluation of the whole hospital, Yang, Sun Hengjun, The four comrades Liu and Shen Shuping were evaluated as the last. According to the provisions of the personnel system reform plan of our hospital, the leading group of the hospital personnel system was responsible for the four last personnel from December 10 to 30, 2003. Training, the current training work has ended.

"Through the training, Yang, Sun, and Liu each had a deep understanding of their own gaps. After their own efforts, they were hired by the department when they competed for posts. Comrade Shen Shuping didn't know why she was rated as the last. The letter to the hospital leader said: I did not make any mistakes, and it is impossible for me to make a review that is not in line with the facts and against my will.”The comprehensive evaluation results after training: Yang, Sun Hengjun, and Liu passed the test, while Shen Shuping failed. " After the circular was issued, Shen Shuping was actually the only laid-off employee in Beidaihe Hospital during the personnel system reform process in 2003. Not only that, the hospital announced on January 7 that Sister Shen, who had worked in the hospital for 32 years, was laid off without a clear written notice, stopped Shen Shuping's work, and maliciously withheld all bonuses from January 2004. And related benefits, part of Shen Shuping's file salary was deducted. When I called Beidaihe Hospital to interview this matter, the hospital denied retaliation. On January 12, 2004, Chen Ming and Zhang Weijie, senior reporters from the Workers' Daily, came to Beidaihe Hospital to conduct an in-depth investigation into the reason why Sister Shen was laid off. Before the Spring Festival in 2004, Sun Shuying, the leader of the Beidaihe Health Bureau, the deputy director of the Propaganda Department of the District Party Committee, and the director of Beidaihe Hospital, and a former hospital director, came to the "Worker's Daily" office with a lot of gifts in an attempt to prevent the newspaper from publishing articles. But reporter Chen Ming sternly refused.However, these leaders once again stated: "The elimination system for hospital staff has been carried out for several years, and the procedure is legal and effective. It is impossible for us to retaliate against them." On February 21, 2004, "Workers' Daily" published a full-page detailed report on the matter by its reporters Zhang Weijie and Chen Ming under the headline "Plaintiff Shen Shuping: Defendant Beidaihe Hospital Laid Off". The reporter asked Vice President Zhu Shen Shuping several times about her work performance over the past few decades, but she did not answer directly. The reporter asked another question: "Shen Shuping has evidence to prove that several hospital leaders and some hospital employees told Shen Shuping that she was laid off because she sued the hospital and was reported by relevant newspapers, which caused a bad influence on the hospital." Zhu Xinxin said: "If some hospital leaders say such things to Shen Shuping, then it cannot represent the hospital, but can only represent them personally. The leadership team of our hospital only had a formal conversation with Shen Shuping personally once, and there is a record of the conversation. " In order to find out the facts, the reporter asked Zhu Xinxin if he could show the transcript of the formal conversation to the reporter, but Zhu Xinxin flatly refused. ... Chen Ming said angrily that no matter how much resistance there is to Shen Shuping's case, we will continue to pay attention to every step of the case. In October 2003, the case was transferred to the People's Court of Funing County, Hebei Province for trial by Qinhuangdao Intermediate People's Court.Unexpectedly, due to the interference of Beidaihe Hospital, this simple civil tort case has experienced twists and turns. The presiding judge of the court, Zheng Mou, refused. Instead, the other party asked the plaintiff to make a medical appraisal according to the judge's intention, and said that if he did not obey the court, he would be sentenced to lose the case.After repeated complaints by Shen Shuping, the case was sent back to the Intermediate People's Court. In April 2004, the Intermediate People's Court appointed the Lulong Court to hear the case.During the trial, the defendant, Beidaihe People's Hospital, first denied that there was no special care, but only first-level care, and refused to hand over the original special care records, and later claimed that the special care records were stolen by the plaintiff, Shen Shuping.It is unbelievable that when the defendant refused to hand over the original special care records, the Lulong court entrusted the Provincial Medical Association to conduct a medical malpractice appraisal ex officio.The plaintiff disagreed with the court's action because the cause of action was "medical damage compensation" rather than medical malpractice, and refused to pay the relevant appraisal fee; later, under the mobilization of the court, the defendant Beidaihe Hospital was responsible for the relevant appraisal fee.At present, this civil case, which has aroused strong repercussions from all walks of life in the local society, is under further trial. At the same time, at the beginning of 2004, the Personnel Arbitration Section of Beidaihe District Labor and Personnel Bureau filed a case for Shen Jie's application for personnel arbitration.During this period, Sister Shen was cheated out of 20,000 yuan of hard-earned money by Qiao Moumou, a female teacher who claimed to be a lawyer at the law school of a university for nationalities in Haidian District, Beijing. .With my help, Ms. Shen angrily took the extremely arrogant Qiao, who never investigated and collected evidence after asking for money, refused to go to the court to read the case file, and didn't even write a word in the complaint, to the court. . In July 2004, the Beijing Haidian District People's Court sought justice for Sister Shen according to law. At the same time, during the national "two sessions" in 2004, while I was running around for my own lawsuit, I also appealed for Sister Shen's lawsuit everywhere, and tried my best to submit her case to relevant people.In the end, Sister Shen’s lawsuit against her hospital and her retaliation by the hospital aroused the attention of famous medical experts, Wang Weizhong, deputy to the National People’s Congress of Jilin Province, Qu Xiuxia and Guo Wenxiang, representatives of the National People’s Congress of Hebei Province, etc. It attracted the attention of Bai Keming, the Governor of Hebei Province who was in Beijing to participate in the "two sessions" of the country and other relevant leaders. My first private prosecution lawsuit in China dragged on for 5 years, and I didn't even have a chance to go to court. Fortunately, Sister Shen, who has been in the lawsuit for 5 years, has some prospects for her two lawsuits.One day in March, she teased me and said, "Shi Ye, you were helping me, but I didn't expect you to have been fighting with others for several years. We are really comrades in arms fighting side by side now." ..."
