Chapter 23 2. Medical identification: second injury?

A weak woman with only a primary school education and no job, in order to find justice for her husband who died unjustly, embarked on a long and long journey of petitioning. At the end of last year, she finally got a fair medical malpractice appraisal result. During the Spring Festival of 1999, she asked a famous local mason to make a tombstone for her deceased husband. The mason asked her what was engraved on the tombstone, and she took out the "Appraisal Letter" from the Provincial Health Department, pointed to the "appraisal conclusion" and said, "Just engrave this."

This unique tombstone has been erected. What does she want to show people? On April 2, 1999, "Sanxiang Metropolis Daily" published He Daoxin's report "I am a person who defends my husband". I believe that every bloody person will feel sad after reading it. On the morning of July 15, 1995, Yang Mingxiang's husband, Xiang Mingfeng, a 38-year-old policeman from the Criminal Police Brigade of the Public Security Bureau of Changyang Tujia Autonomous County, Hubei Province, told her that she felt a pain in her neck when she went out to handle the case.Yang Mingxiang took her husband to the County People's Hospital by force. When he arrived at the hospital, Xiang Mingfeng found that his public medical book had run out, and Yang Mingxiang said helplessly that he had to wait until tomorrow. Before leaving the hospital, they ran into Xiang's colleague Yang Dewang, who also went to the hospital to see a doctor.Yang Mingxiang had an idea and borrowed his medical book for her husband.

The doctor on duty diagnosed it as "inflammation of the submandibular lymph nodes" and prescribed 8 million units of penicillin and 5 grams of penicillin ampicillin. After the infusion, the husband rushed to handle the case. A week later, her husband developed red papules all over his body, which were extremely itchy. Yang Mingxiang accompanied him into the County People's Hospital again. The doctor diagnosed it as "prickly heat", and gave penicillin again.Yang Mingxiang, who grew up in the countryside, had never seen a "heat rash" like this. She was deeply suspicious of the hospital's diagnosis and medication.Sure enough, a week later, my husband had red rashes all over his body, and there were blood spots everywhere from his own scratching.Yang Mingxiang anxiously sent her husband to the hospital, where she was diagnosed with a "drug rash" and treated for allergies, but it didn't work, so she was transferred to the dermatology department.Yang Mingxiang asked to be transferred to another hospital for treatment, but was refused.

On August 26, Changyang County People's Hospital transferred him to Yichang Central Hospital only after the leader of the Public Security Bureau where her husband worked came forward to request. After the examination, the attending doctor was shocked and asked why he waited until the condition was so serious before sending it.Yang Mingxiang faintly sensed that something was wrong from the doctor's unusual questioning. On October 9, the husband was transferred to Hubei Provincial People's Hospital. On October 19, Xiang Mingfeng left his beloved wife and a pair of underage children, and passed away.Yang Mingxiang, heartbroken, returned to Yichang from Wuhan with her husband's urn in her arms in the dark. What she didn't expect was that in the next three years, she would walk on this road countless times with more difficulty and humiliation.

When her husband was alive, Yang Mingxiang was a typical housewife without a job, and her main task every day was to take care of her two children and her husband. The sudden death of her husband was tantamount to the collapse of the sky for Yang Mingxiang and her children. After burying her husband, Yang Mingxiang had spent all their savings, and her life was at a loss. She waited for someone from the hospital to settle the funeral. But even though he looked through his eyes, he didn't see anyone coming from the hospital. As a last resort, Yang Mingxiang walked into the People's Hospital. Unexpectedly, the person in charge who received her said that Xiang Mingfeng's death was due to his own special constitution, and the hospital was not at fault.Yang Mingxiang was not reconciled, and continued to negotiate with the hospital. She went to the hospital more often. Some people thought she was insane and avoided her like a plague god.

In early August 1996, Yang Mingxiang filed a lawsuit in the county court, demanding compensation from the hospital. In accordance with legal procedures, the court entrusted Changyang County Medical Accident Appraisal Committee to conduct medical technology appraisal. On August 21, the appraisal conclusion came out. The Changyang County Hospital denied that Xiang Mingfeng had borrowed Yang Dewang's public medical records, and denied that he had used penicillin and ampicillin on that day. His death was not a medical malpractice.Faced with this conclusion, Yang Mingxiang was furious. Because of the "ironclad evidence" of the appraisal conclusion, Yang Mingxiang lost the lawsuit.

In December 1996, Yang Mingxiang appealed to the Yichang City Intermediate People's Court. The second time he came to Yichang, Yang Mingxiang went to the ward where Xiang Mingfeng lived in Yichang Central Hospital. It was here that although it was difficult for Xiang Mingfeng to speak at that time, he, who has rich experience in solving crimes, did not forget to ask his wife to pay attention to preserving evidence, and mentioned Yang Dewang's public medical records. At that time, Yang Mingxiang's whole body and mind were shrouded in grief, and she didn't take her husband's reminder to heart. By the time she filed a lawsuit with the court, Yang Dewang's public medical records had been used up and replaced with new ones. It was recorded that Xiang Mingfeng's first The public medical record for the use of penicillin and ampicillin has been handed over to the Changyang Health Bureau. This important piece of evidence was lost.

On February 19, 1997, the Yichang Medical Malpractice Appraisal Committee was entrusted by the Yichang Intermediate Court to hold a meeting to identify the cause of Xiang Mingfeng's death. Yang Dewang volunteered to testify again, but he was not allowed to speak at the meeting. On the 21st, the conclusion of the Committee's "Appraisal Letter" was the same as that of Changyang, and at the same time it suggested that Changyang County People's Hospital should seriously implement the outpatient medical record writing system in the future.Yang Mingxiang figured out the "Appraisal Certificate" repeatedly, and found that this "suggestion" actually approved the testimony of Xiang Mingfeng who borrowed the public doctor's book from Yang Dewang, and understood the direction of future efforts. On June 20, the Yichang City Intermediate Court rejected the appeal. But Yang Mingxiang didn't give up just yet, she believed that what is white cannot be black, and what is black cannot be white.

One day in August 1996, a middle-aged woman who sold blood came to the blood bank of Yidu People's Hospital adjacent to Changyang County.Seeing that her physique was too poor, the staff advised her to think carefully. The middle-aged woman replied that she didn't need to think about it, and rolled up her sleeves without hesitation. When filling out the blood card, the middle-aged woman seemed to be unable to remember her name, and thought for a while before saying it. The staff was very strange. The middle-aged woman left in a hurry after receiving more than 300 yuan in blood money.A week later, the woman came to the blood bank to sell blood again, and the name she reported was different from that of a week ago. This middle-aged woman is Yang Mingxiang.

Because of her husband's departure, her family's situation became more and more difficult. She was full of grief and despair, and finally thought of the blood that was not enough on her body. In Changyang County, Xiang Mingfeng's death was widely known, and Yang Mingxiang's act of seeking justice for her husband aroused widespread sympathy and support. In February 1997, through the introduction and hard work of relatives and friends, Yang Mingxiang found a temporary job cleaning the streets, with a monthly salary of more than 300 yuan.In terms of work, Yang Mingxiang is probably the most hardworking person in the Sanitation Institute. People often see her silently cleaning the streets with her head buried. In order to save more money, Yang Mingxiang volunteered to take the early morning and night shifts that others were unwilling to take, and offered to contract the most polluted areas in the county.

After Yang Mingxiang received the judgment of losing the case from the Changyang County Court, she began to post the appeal materials outside, and the copying fee alone cost more than 1,000 yuan. Yang Mingxiang, who hadn't touched pen, ink and paper for many years, picked up a pen. After cleaning the streets every day and settling down the lives of her children, Yang Mingxiang borrowed a dictionary from the children at home and wrote letters neatly to party committees, governments and leaders at all levels, telling Her husband's grievances and her own injustice. She can't remember how many words Yang Mingxiang wrote in the past three years. She only remembers that when she received the final appraisal conclusion from the Hubei Provincial Department of Health, two bottles of "Hero" brand ink had just been used up. In early May 1997, Yang Mingxiang came to Wuhan. She finally found the Hubei Provincial Health Department, where she was warmly received.Since the appraisal conclusion of the Provincial Department of Health has not come down for a long time, in addition to constant urging, Yang Mingxiang went to the doctor in a hurry to search for many departments of the Provincial Party Committee and Provincial Government, most of which she did not know the job functions of those departments. I only know that it is the place where the Communist Party and the people's government are in power, and it is the place where the wronged people should be given explanations. One day in February 1998, Yang Mingxiang blocked a deputy secretary in the car of the Political and Legal Committee of the Hubei Provincial Party Committee. The deputy secretary did not regard her as a lunatic, and listened carefully to what happened to her husband and herself, and told her solemnly that the wrong things would definitely be corrected.Seeing that she looked hungry later, he took her to a restaurant and bought her a meal at his own expense.Yang Mingxiang only felt hot in his heart, and tears rolled in his eyes. Every time I go to Wuhan, apart from a thick book of complaint materials, Yang Mingxiang must bring two other things, one is a large roll of waste newspapers, and the other is a bag of homemade wheat flour cakes.During the more than 100 days and nights spent in Wuhan, Yang Mingxiang satiated his hunger by eating wheat flour cakes and drinking tap water. On July 21, 1998, when the second flood peak of the Yangtze River flood passed through Wuhan, the traffic was interrupted, and she couldn't go home. The wheat flour cakes she brought were all moldy and spoiled. Yang Mingxiang ate them forcibly and waited for the flood. Withdrew, the result was that the stomach was turned upside down, and the vomiting continued.Seeing this, a female cadre from the Provincial Health Department forcibly dragged her to a restaurant, bought her food, and watched her finish eating. The female cadre was moved by her desperate efforts to seek justice for her husband, and the two women shed tears facing each other. At night, Yang Mingxiang found a place with a lot of people on the street and sat down against a telephone pole, covering her face with a few newspapers in her hand. She could only sleep in this way... At 9 a.m. on November 19, 1998, Yang Mingxiang, who was cleaning the streets, finally received the "Technical Appraisal of Xiang Mingfeng's Medical Incident" from the Hubei Provincial Department of Health. The appraisal conclusion reads: "This medical incident is a first-class medical technical accident." Seeing this, Yang Mingxiang couldn't help trembling all over, and collapsed to the ground. In order to reach this long overdue conclusion, Yang Mingxiang traveled to and from Yichang more than 20 times and Wuhan more than 30 times, spending nearly 60,000 yuan, and was already heavily in debt.More than a thousand days and nights, how much money should be used to measure and calculate? At this time, it has been three years and one month since the death of her husband Hanhen. Yang Mingxiang staggered back home, dragging a broom that was much taller than her, and placed the "Appraisal Certificate" neatly in front of the portrait of her deceased husband, crying bitterly. For the next three days, Yang Mingxiang lay paralyzed on the bed, reading the "Appraisal Letter" over and over again, recalling the difficult road she had traveled in the past three years mixed with blood and tears, and the tears flowed down her old cheeks again and again. Yang Mingxiang finally recovered a fair statement, but the price he paid was too great. We don't know whether it is necessary to go through so many hardships and endure such a big blow in order to obtain a fair medical appraisal. A family member of a victim of medical malpractice said sadly to the author: Which family member of the victim has not gone through the ordeal of a narrow escape? Losing a loved one is already a great tragedy, but in order to obtain a fair medical appraisal, one has to go through the ordeal of narrow escapes, which is undoubtedly the tragedy of tragedies. After all the hard work and finally having an authoritative appraisal, will the hospital come to their senses, will Xiang Mingfeng be able to rest in peace, and will Yang Mingxiang be able to soothe his wounded heart? For this reason, the author made a special contact with Yang Mingxiang. In her reply to the author, she said bitterly: "After receiving the provincial conclusion, although I am not satisfied with this conclusion (because it is because the medical staff did it carelessly, without careful diagnosis, they called 'drug rash' It turned out to be 'heat rash', clearly a first-level medical liability accident), but I had no choice but to let it go, because the province is the final decision. I think, now that the paper is in black and white, the hospital should say something... But I thought wrong Yes, half a year after the conclusion came, none of them came to the door, not even a word of apology. Logically, I should resort to the law to seek justice, but I am afraid, because the law is enforced by people, and the first and second instance Losing the lawsuit is an example, besides, they have released the words, there are people in the court. In order to ask for an explanation, the father-in-law fell on the road of appealing, hating Jiuquan, and I am deeply in debt... Now I only have a "blank paper" in my hand, I really don't know what to do..." When the medical appraisal does not constitute a medical malpractice, the hospital side is justified: handle it according to the appraisal conclusion; when the medical appraisal determines that it is a medical malpractice, the hospital side remains indifferent and does not respond. Is this medical appraisal really designed to shirk responsibility for the hospital? Yang Mingxiang said disappointedly: "After my situation was disclosed by a well-meaning reporter, I have received widespread sympathy from those who uphold justice, including you. Even so, I still cannot see the light..." Hearing the sad and helpless sigh of this weak woman, the author can only sigh: the medical accident has caused her to lose her dearest husband, why should we torture and hurt this poor woman again in the identification and handling of the medical accident? What about the woman? In the face of this tearful accusation, how can we not feel condemned by our conscience? On March 18, 1999, the Intermediate People's Court of Benxi City, Liaoning Province held another trial for a medical malpractice case that had lasted for more than eight years. "China Lawyer News" published a report by reporter Liu Heping on April 23, 1999, which disclosed in detail this appalling medical accident and bizarre medical dispute. On January 23, 1991, the 15-month-old only son Wang Leixin of Wang Zuohui, an employee of Benxi Iron and Steel Company, suffered from mild diarrhea and vomiting, accompanied by low-grade fever. diagnosis and treatment. The doctor diagnosed it as: upper flu, enteritis, and carried out the procedures for Wang Leixin to be transferred to Benxi Iron and Steel General Hospital for hospitalization. On the morning of January 24, Wang Zuohui and his wife brought the child to the Department of Pediatrics of Bengang General Hospital. The doctor on duty Zhang Liying went through the hospitalization procedures for the child, and prescribed 150 ml of 10% glucose plus 2.4 million units of penicillin intravenously; 400,000 units of penicillin Unit, another multi-enzyme tablet was given. The child was injected with penicillin intravenously, and the diarrhea in the afternoon was obviously aggravated. When it was the most serious, he had diarrhea every few minutes. The child was restless and crying.Wang Zuohui and his wife said: Doctor Zhang Liying could not be found all afternoon. At night, the child was vomiting and vomiting, accompanied by high fever, Wang Zuohui and his wife found the night shift doctor Zhang Chunjie.Zhang Chunjie looked at the list of inpatients, and said: "Your child has enteritis, don't feed him, I'll go and have a look later." But Zhang Chunjie didn't go to the sick child. At around 10:00 p.m., the child's mother held the child, stopped Zhang Chunjie who was going to the toilet, and asked her to see a doctor for the child.Zhang Chunjie said: "I have already used the medicine during the day, so I don't need to use it anymore. The child is sleepy, please let the child sleep. I will go and see later." However, Zhang Chunjie still did not come.At 11:00 p.m., the child was still vomiting and vomiting, but from then on, they couldn't find Zhang Chunjie all night long. At about 4 o'clock in the morning on January 25, the child had convulsions before dying. At about 5 o'clock, the nurse began to routinely measure the body temperature. The mother of the child told the nurse that the child had convulsions. When the nurse watched the child, the convulsions had stopped. The nurse did nothing and did not report to the doctor. At around 7:10 am on the 25th, the child did not have the usual reaction. After a cry of despair, the mother of the child rushed to the doctor's office again like crazy with the child in her arms, kicked open the door and broke in. Zhang Chunjie picked up the stethoscope this time, and when she heard that the child's heart sounds had disappeared, she Panic. At this time, the flustered medical staff finally found a sphygmomanometer to take a measurement, and the child's blood pressure became zero. The child's family members said that from then on, Zhang Chunjie disappeared again, and she hid aside.Rescue began, but it was too late. The child, Wang Leixin, never opened his eyes again. The child's mother went into shock, and the child's father acted like a fool. He held the cold child all day to prevent others from disturbing his "sleep". On the day of the child's death, the child's father Wang Zuohui saw the child's medical record in the doctor's office, and there were very few records on it.He stuffed his medical records into his leather jacket.Soon, the medical chief of the hospital asked him for the medical record, and he gave it to him.Wang Zuohui never imagined that since he handed over the disease history, the disease history has changed drastically like a magic trick. (—lesson: why not make a copy?) On the afternoon of the day when the child died, Wang Zuohui's father, Wang Xinting, returned home from out of town.At Wang Xinting's request, a joint investigation team was formed by Benxi Iron and Steel General Hospital and the units where Wang Zuohui and his wife belonged, and began to investigate the death of the child. On January 26, the autopsy team organized by the Benxi City Health Bureau conducted an autopsy on the child's body.During the autopsy, Wang Xinting's request to have a forensic doctor participate was rejected.During the autopsy, Wang Xinting's third son (the deceased's uncle Wang Zuopeng) also saw the child's medical record with little writing at the scene. However, since then, he has never seen the word "enteritis" in the medical records of the receiving department. On January 31, Benxi Iron and Steel General Hospital held an analysis meeting. After the meeting, the family members of the child asked for a copy of the medical record, and the deputy chief of the medical department told them that the medical record was lost.Agitated, Wang Xinting came to the medical department downstairs, but there he found two bags of "disease records" with the names of the children on them.Wang Xinting couldn't care less, and took all these two bags of medical records into his hands. When they opened these medical records, they found that the medical records had changed drastically. The original few records have been greatly increased, and the medical records are complete and neat, and the content is sufficient and specific.Wang Xinting reported the rewriting of the medical record to the Municipal Health Bureau. However, Wang Xinting said that the evil consequences of this false medical records have not been eliminated.Because the "medical malpractice appraisal" of Benxi Iron and Steel General Hospital was made according to it.It also lingered in subsequent appraisals. On the afternoon of February 23, 1991, Benxi Iron and Steel General Hospital conveyed to Wang Xinting the conclusion of the appraisal of the medical accident: a first-grade technical accident.Because it is just a technical accident, there is no issue of criminal responsibility.Regarding the identification of Benxi Iron and Steel General Hospital, Wang Xinting asked what was the basis for identifying it as a technical accident? The answer from the hospital was: original medical record and autopsy report.Wang Xinting asked: Isn't the original disease record lost? The hospital replied: They were found again on February 25. Wang Xinting refused to accept the appraisal by Benxi Iron and Steel General Hospital, and applied for re-appraisal to the Benxi Municipal Health Bureau, and put forward four requirements: first, to determine the real cause of death of the child; second, to determine the nature of the medical malpractice; The purpose of medical records; the fourth is to re-identify the results of pathological anatomy. On March 13, the Benxi Medical Malpractice Appraisal Committee organized an appraisal of the accident. The appraiser only saw the medical record, but failed to see the four requirements and related materials that are very important to the appraisal. However, in the medical record submitted to the appraiser for reading, there was a forged copy of page 6. On March 30, Wang Xinting applied for re-evaluation to the Liaoning Provincial Health Department. The Provincial Department of Health refused to make an appraisal because of incomplete original data.Over the next two years, Wang Xinting went to the relevant departments at various levels to appeal again and again, and the Liaoning Provincial Procuratorate did a lot of work on the case. In March 1995, the Deputy Chief Procurator of the Liaoning Provincial Procuratorate came to Benxi, learned about the situation, and transferred the case files. In May, the provincial procuratorate sent people to Benxi twice to conduct detailed investigations. Finally, the Procuratorate Committee of the Provincial Procuratorate decided to hand over the case to the Pingshan District Procuratorate of Benxi City, and prosecute Zhang Chunjie and Zhang Liying, who were responsible for the accident, for the crime of dereliction of duty. In December 1995, the Pingshan District Procuratorate filed a lawsuit with the Pingshan District Court. This medical malpractice, which has been entangled for nearly five years, has begun to embark on the road to be resolved through judicial procedures. In August 1996, after the Pingshan District Court heard the case for the first time, it transferred the case to the Benxi City Intermediate Court. The procuratorial organ asked for instructions step by step, and finally the provincial procuratorate believed that the prosecution was correct and decided to still prosecute.By March 1997, the case went to the Provincial High Court after going through the process of withdrawal and prosecution many times. After review, the Provincial High Court issued an instruction to withdraw the case file. In the following three months, the case file was returned and returned hundreds of times. On February 10, 1998, the Pingshan District Court of Benxi City made the first-instance judgment. On June 29, 2010, the State Council promulgated Article 21 of the "Measures for Handling Hospital Accidents", which stipulates that this case is not a criminal case, and the prosecution's charge of the two defendants for the crime of dereliction of duty cannot be established." The verdict acquitted the two defendants, Zhang Chunjie and Zhang Liying. Against the first-instance judgment of the Pingshan District Court, the Pingshan District Procuratorate filed a protest to the Benxi City Intermediate Court. On April 27, 1998, the Benxi City Intermediate Court made a second-instance ruling: "Reject the protest and uphold the original judgment." On August 27, 1998, the Liaoning Provincial Procuratorate filed a protest against the case to the Liaoning Provincial High Court, demanding that Zhang Chunjie and Zhang Liying be held accountable. criminal responsibility. The High Court of Liaoning Province ordered the Intermediate Court of Benxi City to retry the case. On the morning of March 18, 1999, the Intermediate Court of Benxi City opened a trial again. Zhang Chunjie was unable to appear in court due to illness, and the court suspended her trial according to law.Only Zhang Liying stood in the dock. The court has opened, and the two parties with diametrically opposite views have already stated the disputed facts many times.According to Zhang Chunjie's materials, how she examined the child normally at that time, her fault was that she did not pay enough attention to the child's condition. The reason given by the procuratorate and Wang Xinting was also very simple: enteritis in the child was a common and frequently occurring disease. For Zhang Chunjie and Zhang Liying, this disease should not have resulted in death. However, the child died. On April 9, 1999, the Benxi City Intermediate Court held a court session, and the final verdict was pronounced on the case that lasted more than eight years. In the solemn court, the presiding judge pronounced the verdict: the defendant Zhang Liying was sentenced to one year’s imprisonment with a two-year probation for the crime of medical malpractice. The other defendant, Zhang Chunjie, decided to try another case due to his illness. So far, the dead toddler has been frozen in the hospital for eight years. Perhaps this judgment is still not the final result of the case, but it has set a precedent in the history of criminal trials in our country to pursue criminal responsibility for a person identified as responsible for a technical accident. For a long time, after the occurrence of many medical accidents, the relevant appraisal departments either identified them as medical accidents or medical technology accidents, and the parties often used this as a shield to shirk responsibility and avoid punishment. The criminal responsibility of the person responsible for the technical accident undoubtedly sounded the alarm to those malfeasant doctors, and it was also a veto of unfair medical appraisal. While we were happy, we couldn’t help but feel a pang of sadness—if the family members of the deceased hadn’t fought unyieldingly for eight years, and if the Liaoning Provincial Procuratorate hadn’t upheld justice, the dead child would have been frozen in the hospital for how long! On August 14, 1998, "Southern Weekend" published a report by Chen Jianjun, the paper's Shanghai-based reporter, which showed a tragic scene in the health industry—the husband died suddenly in the hospital while hanging salt water, and the wife died suddenly from the health bureau while begging for justice. On July 20, 1997, Jiang Baogen, who worked as a department manager in a company after retirement, had an electrocardiogram at Shanghai Ruijin Hospital, and the conclusion was "sinus tachycardia". On the morning of the 24th, Jiang Baogen felt depressed, short of breath and heartache, so his wife Zhu Meiying accompanied him to the Huaihai Middle Road Hospital near his home for medical treatment.Zhu Meiying was worried about her husband's condition and asked the doctor to do an electrocardiogram. The attending doctor thought that it was only two days after the electrocardiogram was done, and even if the disease progressed, he could not see clearly, so there was no need to do another electrocardiogram. So, according to the doctor's instructions, Jiang Baogen did blood routine, urine routine and chest X-ray examination. The results of chest X-ray showed that the apex of the heart shifted to the lower left, the aorta was widened, and the markings of both lungs were deepened.Zhu Meiying asked for an electrocardiogram again, but the doctor refused.Regarding Jiang Baogen’s condition, the attending doctor’s conclusion was: “The cause of heart palpitations needs to be investigated.” When Jiang Baogen’s urine routine conclusion was protein 3+, the doctor prescribed glucose, sodium chloride, etc. Rehydration prescriptions used. At about 11 o'clock that day, on a chair in the hospital corridor, a nurse inserted a needle into Jiang Baogen's blood vessel. After hanging in salt water for a while, Jiang Baogen was hungry, so Zhu Meiying went to buy biscuits and water for him.The first bottle of salt water was hung halfway. Seeing that her husband was fine, Zhu Meiying went home to eat. This departure is the eternal farewell between husband and wife. When Zhu Meiying was dragged to the hospital by the nurses, the ambulance had already stopped at the entrance of the hospital.Jiang Baogen was still sitting on the chair he had been sitting on when he was hanging salt water, his head was tilted to one side, white foam was flowing from his mouth, and he was incontinent when he urinate... All the infusion needles have been removed, and there are some medical staff standing around, and there is no sign of ineffective rescue .Jiang Baogen was immediately carried into an ambulance and taken to Ruijin Hospital. After Jiang Baogen was sent to Ruijin Hospital, Ruijin Hospital concluded that the patient had died.An incredible scene followed, and there were two theories about the time and place of Jiang Baogen's death: one was identified by the Huaihai Middle Road Hospital, and the other was provided by the Shanghai Medical Emergency Center. The version of Huaihai Middle Road Hospital is as follows: when the second bottle of saline solution was removed by 100ml (14:25), Jiang Baogen said he was not feeling well, and the nurse on duty was about to remove the rehydration solution, and immediately notified the electrocardiogram room and physicians to arrive for diagnosis and treatment. After the examination, while giving oxygen inhalation treatment, the electrocardiogram was observed, and the diagnosis was "acute inferior wall myocardial infarction" according to the fluctuation of the electrocardiogram. At around 14:38, the ambulance and the family members of the patient arrived one after another, and the patient who still had a beating heart was sent to the ambulance. After arriving at Ruijin Hospital about 10 minutes later, the heartbeat disappeared, and the subsequent rescue by the medical staff of Ruijin Hospital no longer worked. The Shanghai Medical Ambulance Center said something else entirely: the ambulance dispatched at 14:26, and arrived at the hospital on Huaihai Middle Road at 14:30, and was diagnosed at 14:31 with no breathing or heartbeat. (The delivery time signed by Zhu Meiying on the notice of serious illness and critical illness issued by the medical rescue center was also 14:31), and the arrival time at Ruijin Hospital was 14:40. The statement of the Shanghai Medical Rescue Center is supported by detailed pre-hospital records and other original materials, while the statement of the Huaihai Middle Road Hospital is relatively pale, and there are some things that are difficult to justify. After the incident, the Huaihai Middle Road Hospital took out two electrocardiograms, which were said to have been taken for Jiang Baogen at 12:30 and 14:40 on the same day.Zhu Meiying said that at 12:30, she was with her husband and did not have an electrocardiogram at all.The hospital also could not produce medical records and evidence of charges. Moreover, according to the hospital, Jiang Baogen was sent to the ambulance at 14:38, and it would be impossible to have an ECG at the Huaihai Middle Road Hospital at 14:40! After the incident, Jiang's family received several anonymous calls. The caller, who claimed to be a medical staff member of the Huaihai Middle Road Hospital, said that the hospital did not rescue Jiang Baogen at all, and Jiang Baogen was already dead when the problem was discovered. The lie has been revealed. However, on November 7, 1997, the "Medical Malpractice Appraisal Certificate" issued by the Shanghai Luwan District Medical Malpractice Appraisal Committee held that the Jiang Baogen incident did not constitute a medical malpractice, and that the death was caused by a sudden change in his condition. Myocardial infarction with third-degree atrioventricular block", the Huaihai Middle Road Hospital treated the symptoms correctly, and there was no nursing error that caused the patient's direct death during the diagnosis and treatment process. The Jiang family refused to accept it and demanded a re-appraisal. On July 10, 1998, the Shanghai Medical Malpractice Appraisal Committee issued an appraisal certificate, arguing that Jiang Baogen's death was due to the evolution of his illness. Since no autopsy was performed, the exact cause of death was unknown, and his symptoms were not typical. There is insufficient awareness of the severity of the disease, but the basis for determining that the death of the patient was directly caused by the negligence of the medical staff is insufficient, so it is not a medical malpractice. When and where Jiang Baogen died is the key to this case.Zhu Meiying was filled with righteous indignation when the Luwan District and Shanghai Medical Malpractice Appraisal Committees evaded this issue.Jiang's family visited the Luwan District and the Shanghai Municipal Government successively. The materials were only circulated, and then they were quickly transferred to the Health Bureau.Zhu Meiying was going to sue in court, but she found out when she went to the Shanghai Higher People's Court for consultation. If the Medical Malpractice Appraisal Committee of the Health Bureau did not find it a medical malpractice, she could not sue for it. July 21, 1998 was Zhu Meiying's third day as the director of Shanghai Changyi Wool Sweater Factory, and there were endless things to do in the factory. However, in three days' time, it would be the anniversary of her husband Jiang Baogen's death. The closer this day came, the heavier the weight of lead in Zhu Meiying's heart. In the morning, she got up early, planning to go back to the factory immediately after going to the health bureau to appeal. The mother and son were stopped at the concierge before they entered the petition office of the Shanghai Municipal Health Bureau. An old comrade said, "I am from the petition office, please tell me." The conclusion is doubtful, and I hope that the Health Bureau will re-investigate the real cause of Jiang Baogen's death, the exact time and place of death, and investigate the responsibility of the Huaihai Middle Road Hospital in accordance with the law.Zhu Meiying spoke for about 20 minutes when her head suddenly turned to one side and her body fell from the chair to the ground.Jiang Jie, who was staring at his mother talking, rushed to hug his mother, her lips were already tightly closed, and she couldn't hear her son's cries at all.A few minutes later, when the doctors from the outpatient room of the Shanghai Municipal People's Government arrived, they were unable to recover, and Zhu Meiying passed away. I don't know if these two lives can also slightly touch the rigid medical malpractice handling mechanism?
