This cannot rule out the influence of secular prejudice.Most importantly, she was deprived of her right to be a mother.黄杰称自己因事故影响,经常精神恍惚,无法保证安全驾驶而不得不卖掉了汽车,不敢到单位上班开车;林丽燕整日以泪洗脸,不能自持,严重影响工作、生活。黄杰悲愤地说,当面对女儿因听到传闻,天真地问起什么是子宫、自己的子宫是否已被切除的时候,夫妇俩只能无言以对,更加担心女儿懂事之后能否承受得了如此沉重的打击。 被告方坚持按国务院《医疗事故处理办法》及福建省《医疗事故处理办法实施细则》规定的赔偿标准理赔,但表示可适当提高,并答辩说:原告黄小妹可以抱养孩子,解决养老问题。 好一个绝妙的回答!依此而言,手术把一个人好端端的腿切掉了,没什么,买副拐杖就行了;即使手术将一个人致死了,也没有什么大不了的事情,孩子的父母还可以再生一个,生不出了,也可以到福利院去领养一个……生命和健康,在他们眼里竟是这样地无所谓,这样地不值钱! 1997年4月4日清晨,中央电视台《东方时空》栏目报道了这起悲剧后,引起全社会的震动,小女孩的命运也牵动了许多善良百姓的心。 就阑尾和子宫的解剖位置,北京医科大学解剖学主任于教授在接受采访时说:“子宫和阑尾的位置、形状相差很大,做阑尾切除术应该说普通外科医生就能完成,对实习医生尽量要求独立完成,而对临床外科医生就不言而喻了。” 刘淑英,已当了一二十年医生,做过多起阑尾手术。但在这起阑尾切除手术中,她没有按手术操作规程寻找阑尾致使误将子宫当作阑尾分离。当医院对她作出处理决定后,刘淑英并未下乡镇卫生院锻炼,而是远度重洋,定居新西兰了。 1998年5月12日,福建省高级人民法院作出终审判决,依法判决龙岩市第一医院赔偿黄小妹医疗费、残疾生活补助费、精神损害赔偿金等费用共计246622元,其中精神损害赔偿金为15万元。 官司算是完结了,表面看来黄杰、林丽燕是赢家,可他们毫无欣悦之色。再多的钱,也弥补不了女儿终身的缺陷,女儿未来的道路不知将会是多么暗淡与无奈! 黄小妹的官司已在全国闹得沸沸扬扬,而更加可悲的是,仍有许多医务人员没有从中吸取教训,类似的悲剧还在不断发生…… 1997年11月15日的《中国商报》报道:1997年3月9日,广州市海珠区少年宫青年舞蹈教师李丹青突然感到右下腹疼痛,被送到广州海珠区第一人民医院就诊,医生诊断为急性阑尾炎。医生对她说,做手术切除吧,简单的小手术。李老师被医生的乐观态度所感染,当即表示同意,次日即在该院进行了手术。 李丹青做梦也没有想到,就是这个简单的小手术,让她抱憾终生:医生竟然错将她的右侧输卵管切除,而发炎了的阑尾仍留在体内。 术后,李老师一直感到腹部疼痛,不能久坐,腰伸不直,后来甚至发展到一翻身就会觉得肠子在腹部滑动,要用手托住才行。李老师问这是怎么一回事,医生说是术后的正常反应,并要李老师坚强些。 2月24日,李丹青同家属准备办理出院手续时,该院领导和外科负责人告知病人家属:有关部门的活检病理报告表明,在切除李丹青的阑尾手术过程中发生了严重的医疗事故,医生错将李丹青的右输卵管当作阑尾切除了,而真正的阑尾仍留在体内。坦率承认了错误的院方却没有再采取其他补救措施,而是建议病人先回家休养,出现腹痛时再来院就诊。被这突如其来的消息弄得手足无措的李丹青听从了院方的意见,只好回家休养。 3月30日夜,病人再次大面积腹痛,第二次被送进了该医院。这次诊断为“肠胃功能不好,消化不良”。4月2日,对该医院失去了信任的家属将病人转送到珠江医院,经诊断为“盆腔炎,肠粘连”。珠江医院的主治医生在分析病因时指出:“遗留有炎症的阑尾在腹腔内,其炎症可引起盆腔及肠间积脓,最后导致慢性盆腔炎,肠粘连。”李老师只好在珠江医院实施了第二次手术,将有炎症的阑尾切除,此后病情才逐渐好转。 李老师就此进行了上诉,要求医院赔偿其终身缺陷5万元、身体伤害费10万元、精神损失费30万元。而院方却认为,事故的责任虽然在自己一方,但按海珠区医疗鉴定委员会的鉴定,只属三级医疗技术事故,按照广东省日前执行的赔偿规定,病人只能获得一次性赔偿1万元。双方意见相差太远,只能听从法院裁决。事过一年多,1998年12月11日,法院判决;当事医生水平不高,未能及时发现发炎的阑尾在继续感染,还误以为炎症已得到控制,从而导致了盆腔炎等并发症,并误切了病人的输卵管,对病人的身体造成不必要的伤害,从而侵犯了病人的健康权,医院一次性赔偿病人16万元。 那边“谁来还我女儿身”的呼吁不绝于耳,这边却又有男人在凄凉地呼号:谁来还我男儿身? 据1999年5月8日的《新华日报》报道,先后荣获江苏省“双十佳税务官”、“省先进工作者”等光荣称号的丰县人大代表、65岁的张奉轲做梦也想不到,一次小小的手术竟把他的“生命之根”切断,使他在花甲之年变成了“太监”。两年多来,张奉轲含着泪,忍着悲,蒙着辱,一直在追寻医疗事故的最后说法,至今尚在诉途中。 张奉轲的投诉材料,字字是泪—— 我从1991年发病,下腹常有下坠感,先后跑了不少医院,有的按前列腺炎治疗,有的按睾丸炎治疗,均无效。经医生推荐,1995年10月25日我来到山东医科大学附属医院看专家门诊,经电热成像CET检查确诊为:睾丸附睾正常,双精索静脉曲张。医院提示可手术治疗。我带着确诊病历和材料于11月1日到丰县人民医院泌尿科,向王业勇医生作了详细介绍,他用手摸了一下我的睾丸,说:“不复杂,小手术。给你治好不坠就是啦。”11月8日,王业勇为我做了手术,一个月后出院。回家没几天,我就感到下腹疼痛难忍。刚开始,也没在意,以为是刀口痛。哪知两三个月后,我的阴毛突然脱落,喉结变小,声音变细变尖,性功能完全丧失,乳房增大,下腹下坠感更为严重。1996年12月3日,我只好又去山东医科大学附属医院诊断,专家问我,好好的附睾,为什么要切除掉?直到此时,我才知道自己的附睾被王业勇手术割掉。我问医生,我下腹仍有下坠感,不知怎么回事?专家说,你的病灶未去,还得再手术。 1997年2月21日,我到徐州九七医院进一步诊断,专家会诊结论为:仍需做双侧精索高位结扎手术,才能解决下坠问题。根据两家大医院诊断结果,2月25日,我到丰县人民医院向王业勇查问情况。 我问:“原定好的双精索静脉曲张手术,你为何在手术中突然改变方案,将我正常的附睾切除了?”王业勇说:“因为你附睾有病症,只好切除。”我说:“手术前你为什么不告诉我?山东医科大学附属医院的专家和仪器确诊的'附睾正常',你又怎么解释?”王说:“仪器管啥,按你的年龄也可将之切除了,这样还可防前列腺肥大。”我说,按你的理论,那岂不是所有像我这年岁的男人都该将附睾切除啦?王业勇听了我的质问后哑口无言。 为了讨回公道,张奉轲向丰县医院、县卫生局等部门多次反映,但至今为止还没有结果。 这不是绝无仅有的悲剧。《服务导报》发表了一篇报道,披露了另一起更加恐怖的医疗事故:一位7岁的小男孩因包皮手术连动五刀,最后生殖器严重损伤,造成睾丸停止发育,整个残留部分面目全非,惨不忍睹。 1997年3月28日,5岁的吕鹏因腮腺炎住进四川省宜宾市二医院,被外二科主任医师吴霖查出“阴茎包皮过长,必须及时手术”。腮腺炎治愈后,4月16日下午进行包皮切除术。手术长达两小时,术后吴霖医师告诉吕鹏的妈妈吕永珍,回家后到附近卫生院打针输液消炎。当晚吕鹏在家惨叫不已,并发现臀部有一寸多长的烧伤。第三天,吴霖到吕鹏家换药,安慰说:“没问题!” 然而,后来的事实证明,烧伤的不仅是臀部,主要是阴茎被烧伤、尿管被烧坏。接着是发炎、水肿,坏死的肌肉变黑,感染化脓。 4月底,吕鹏的烧伤部位已经化脓。吴医生又在他妻子工作的宜宾市民生医院妇产科,由他夫妇俩给吕鹏做第二次手术,把脓块切除,缝合20多针。这一刀的结果是阴囊扭曲缺损,尿路改道。5月23日出院时,仍然在流脓。吴医生要求用高锰酸钾洗伤口,待伤口愈合后再进行第三次手术。 吕鹏的妈妈害怕吴医生开第三刀,便把孩子背到市人民医院。人民医院的医生一看被吓了一跳,建议吕永珍立即向市卫生局汇报。卫生局建议“原来在哪个医院医的还在哪家医院医”。于是又转回了二医院。但二医院不同意住院治疗,在门诊治了十多天了,吕鹏的痛苦仍未减轻。吕永珍遂背着儿子到照相馆,摄下儿子的残相,分装100多个信封,内附求救信,寄往全国各地医院。 同时吕永珍也要求二医院请专家会诊。泸州医学院的李红卫教授来到二医院。通过细菌培养,证明是烧伤坏死肌肉感染,做了第三次手术。7月初伤口好转,但没有了排尿的通道。情况更加危急。二医院又在全麻醉状态下“通尿道”,然后能流出一点,7月31日又排不出尿,又去二医院住院。8月7日突然尿流不止,尿湿了所有的裤子和毛巾。又住进二医院,又一次做尿道手术不成功。 第五次,也是到目前为止的最后一次手术是在华西医大附一院做的。老教授一看吕鹏的惨相惊骇不已,残局无法收拾,只好用导尿管代替排尿。 吕鹏的妈妈吕永珍19岁时遭受意外事故丧失部分劳动能力,民政局发给她一个“综合残疾”证。后在宜宾市下渡口开了一个小饭馆,照顾着生病的母亲,也没有结婚,直到35岁那年的一个早晨,一个刚生下不久、被扔在垃圾堆的男婴激起了她做母亲的渴望。她把孩子拣回来,抱到公证处,给他取名吕鹏,要他志向高远。吕永珍把吕鹏视若命根,把他调教得人见人爱。吕永珍还写了一本又一本的《教子日记》。不过,这本日记从1997年4月16日以后变得字字血泪,不忍卒读了。在这20个月600个日子里,吕永珍用她伤残的腰,背着儿子去成都,去上海,爬了数不清的楼,无数次倒在异乡的街头。身心交瘁的吕永珍的左手四个指头又被机器绞残,饭馆的生意无力顾及,已经背上数万元债务。 1998年12月14日,宜宾市医疗事故鉴定委员会作出结论为“三级医疗技术事故”。吕永珍不服鉴定书中对责任的认定,又于前不久向省级鉴定部门申诉,省卫生厅需要重新向宜宾方面调档,而吕永珍说,她在二医院每次出院都没有出院证明,她争取到的一个病历“是伪造的”。与此同时,吕永珍请了代理律师,本市的律师对吴霖医生取证后,吴霖拒绝在笔录上签字,代理搁浅。吕永珍又背着儿子去省城找律师,但她已经无力交付代理费。 有关专家说,待吕鹏疤痕软化之后,需要再做几次尿道造形手术,但也仅限于为了排尿的方便。随着青春期的到来,吕鹏将不会出现第二性征,却会出现非男非女的变异。 这意味着,小吕鹏成了一个现代的“太监”。 一起医疗事故,便是一场扰人心魄的噩梦,一场抱憾终身的悲剧,为此我们不能不再次奉劝有关医务人员一声:手术刀,千万不要乱割!
